PossibleNOW Contact Center Survey Illustrates Why Many Businesses Fail to Adhere to Changing Telemarketing Regulations

Awareness of the FCC RND & Florida’s Telephone Solicitation Law Are Low 

DULUTH, Ga. – (October 19, 2021) – PossibleNOW, a leading provider of consumer regulatory compliance, and consent and preference management solutions, announced today results of its latest industry survey regarding the awareness of and compliance with the most recent contact center regulatory changes.  

The online survey was presented to more than 500 business decision makers, marketers and operations managers the first week of August. It was designed to take the pulse on two recent call center regulatory changes, including familiarity with the FCC Reassigned Numbers Database (RND), and the recently passed Florida Telephone Solicitation Act (SB 1120).   

The FCC Reassigned Numbers Database, provides the ability to identify numbers that have been permanently disconnected, so that they can be removed from calling campaigns. Companies that do so, create a safe harbor if any of the numbers they called were reassigned to someone other than whom they had consent to call.  

The new Florida SB 1120, was created in response to the supreme court ruling on Facebook, which narrowed the definition of an auto dialer and as a result, eased restrictions on telemarketing. The Florida SB 1120 bill updates the Florida Consumer Protection Law and the Florida Telemarketing Act and creates what is basically another version of the TCPA. The proposed changes could have a significant impact on a company’s ability to call and text prospects and customers and exposes businesses to both liability from government intervention as well as private right of action. 

  • According to the survey results, approximately 66% of respondents said they are currently leveraging auto dialers in their outbound calling campaigns, and 16% were unsure if auto dialers are part of their telemarketing strategy. 
  • Interestingly, 60% are either unfamiliar or unsure of the recently introduced FCC Reassigned (telephone) Numbers Database which allows callers to determine whether a number has been permanently disconnected. 
  • Another 60% either do not have procedures in place or are unsure of the procedures necessary to identify and remove permanently disconnected phone numbers. 
  • Seventy-six percent (76%) are either unfamiliar or unsure of the recently updated Florida Telemarketing Act (SB 1120) that extends beyond certain limitations of the TCPA. Another 51% said, they are unsure if they have new procedures in place to comply with the new Florida Telemarketing Act. 
  • Twenty-five percent (25%) said they update their compliance requirements quarterly, while another 25% said they update their requirements annually.
