Birch Communications Leaders Pleased with U.S. Supreme Court Decision Affirming Cost-Based Pricing for CLECs

Atlanta, GA – June 14, 2011-Leaders within Birch Communications, Inc., a leading IP-based telecommunications and managed services provider to small- and medium-sized businesses, applaud last week’s U.S. Supreme Court decision requiring AT&T to lease entrance facilities for interconnection purposes to other carriers at cost-based rates. These transmission facilities connect competitive providers’ networks with the incumbent LEC network for the mutual exchange of telecommunications traffic.

“This is a victory for the competitive telecom industry. The recent ruling emphasized the details defined in the original Telecom Act of 1996, and ends some of the individual state struggles between CLECs and incumbent providers,” said Vincent M. Oddo, Birch’s president and chief executive officer. “In affirming the statutory right of competitive carriers to obtain cost-based interconnection, this decision provides much needed certainty for the future.”

“The high court’s support of the FCC’s decision in this case demonstrates unequivocally that the competitive protections in the federal telecom act are still the law of the land,” said Chris Bunce, vice president, legal, and general counsel for Birch.
